SUBSTITUTED TRUSTEE'S NOTICE OF SALE

WHEREAS, James I. Moore, Grantor, executed a Land Deed of Trust to Carl Vowell, dated October 21, 2014 which is recorded in Attala County, Mississippi Land Deed of Trust Book 1032, at page 505 thereof, securing an indebtedness therein described due and owing to Carl Vowell, therein called Beneficiary; and,
WHEREAS, Carl Vowell is the present owner and holder of the said Deed of Trust and the note it secures, which said note is unpaid and remains due and owing; and,
WHEREAS, Carl Vowell, the legal holder of said Deed of Trust and note secured thereby, substituted Doug S. Crosby as Trustee therein as authorized by the terms thereof by an instrument dated the March 6, 2019, and recorded in the Office of the Chancery Clerk of Attala  County, Mississippi on the April 18, 2019, in Deed of Trust Book 1130 at Page 176 thereof; and
WHEREAS, default having been made in the performance of the conditions and stipulations as set forth in said deed of trust and the entire debt secured thereby having been declared to be due and payable in accordance with the terms of said Deed of Trust, and having been requested so to do by Carl Vowell, the legal holder of the indebtedness secured and described by said deed of trust, notice is hereby given that I, Doug S. Crosby, Substitute Trustee, by virtue of the authority conferred upon me in said deed of trust, will offer for sale and will sell at public outcry to the highest and best bidder for cash, during legal hours (being the hours of 10:00 A.M. to 4:00 P.M.), at the North front door of the Attala County Courthouse on Friday, the May 17, 2019, the following described land and property located and situated in the ATTALA COUNTY, MISSISSIPPI, to-wit:

A lot or parcel of land lying and being situated in the SW 1/4 of Section 20, Township 14 N, Range 7 East, Attala County, Mississippi, being more particularly described as follows: Commencing at the NE corner of the SW 1/4 of Section 20, Township 14 North, Range 7 East, measure thence South 791.5 feet to a point on the Soutern right-of-way boundary line of the Business Route of Mississippi State Highway No. 12; thence South 36̊30' West along said right-of-way boundary line of said highway a distance of 1590 feet to a point, which said point marks the point of beginning of the lot or parcel of land herein conveyed.  From said POINT OF BEGINNING run thence South 50̊15' East 120 feet; run thence South 30̊30' West 60 feet to a point, run thence North 50̊15' West 120 feet to a point on the SE right-of-way boundary line of the Business Route of Mississippi State Highway No. 12; run thence along said boundary line North 36̊30' East 60 feet back to the POINT OF BEGINNING.  Said lot or parcel of land is located in the SW 1/4 of Section 20, Township 14 North, Range 7 East, and contains a total of 0.16 acre, more or less.

The above property is the same property as conveyed to James I. Moore by Marvin Larry Pickle by that certain Warranty Deed dated February 18, 1986 and recorded in Attala County, Mississippi Land Deed Book 415 at page 450 thereof.

Title to the above described property is believed to be good, but I will convey only such title as is vested in me as Substitute Trustee.

SUBSTITUTE TRUSTEE’S NOTICE OF SALE

WHEREAS, on June 12, 2003, Charles E. Adcock and wife, Dawn Adcock, executed a deed of trust for the benefit of Merchants and Farmers Bank, which deed of trust was recorded on June 17, 2003, in Book 738, Page 406 in and re-recorded in Book 740, Page 10 in the office of the Chancery Clerk of Attala County, Mississippi; and
WHEREAS, the aforementioned deed of trust was assigned by Merchants and Farmers Bank to Mortgage Electronic Registration Systems, Inc., its successors and assigns, by instrument dated June 12, 2003, and recorded on June 17, 2003, in Book 738, Page 423 of the records of the aforesaid Chancery Clerk; and
WHEREAS, the aforementioned deed of trust was assigned by Mortgage Electronic Registration Systems, Inc. to Cenlar FSB, by instrument dated August 21, 2013, and recorded on September 20, 2013, in Book 998, Page 270 of the records of the aforesaid Chancery Clerk; and
WHEREAS, Cenlar FSB, the holder of the deed of trust, substituted McCalla Raymer Leibert Pierce, LLC as Trustee, as authorized by the terms thereof, by instrument recorded on December 17, 2018, and spread at large upon the records in the office of the aforesaid Chancery Clerk in Book 1122, Page 406, prior to the posting and publication of this notice; and
WHEREAS, default having been made in the terms and conditions of the deed of trust, and the entire debt secured thereby having been declared to be due and payable in accordance with the terms of the deed of trust, and the legal holder of said indebtedness, Cenlar FSB, has requested the undersigned Substitute Trustee to execute the trust and sell said land, property and improvements in accordance with the terms of the deed of trust for the purpose of raising the sums due thereunder, together with attorney's fees, Substitute Trustee’s fees and expenses of sale;

THEREFORE, on May 30, 2019, the undersigned Substitute Trustee in the deed of trust, will offer for sale at public outcry and sell to the highest bidder for cash, within legal hours (being between the hours of 11:00 a.m. and 4:00 p.m.) at the South door of the Attala County Courthouse in Kosciusko, Mississippi, the following described land, property and improvements lying and being situate in Attala County, Mississippi, to-wit:

Lot No. 15 of Cavalier Subdivision, according to a map or plat of said subdivision of file and of record in Plat Book 3, page 35 thereof, in the office of the Chancery Clerk of Attala County, Mississippi, said lot being located and situated in the NE 1/4 of the NE 1/4 of Section 29, Township 14 North, Range 7 East.
I WILL CONVEY only such title as is vested in the Substitute Trustee.

The Board reserves the right to reject any and all bids filed.

In renting said Excavator, the Board reserves the right to (1) take advantage of Section 19-13-17 of the 1972 CODE OF MISSISSIPPI, and pay therefor in installments, or (2) take advantage of the provisions of Section 65-7-95 of the 1972 CODE OF MISSISSIPPI, and to hire or lease same, or (3) pay cash in its discretion.
